NATIONAL ASSOCIATION OF FORECLOSURE DEFENSE ADVOCATES

The National Association of Foreclosure Defense Advocates (NAFDA) is the fastest growing network of attorneys committed to assisting homeowners in fighting unlawful foreclosures. We are a charitable and educational non-profit organization awaiting exemption status under Section 501c(3) of the Internal Revenue Code.* NAFDA provides its members—attorneys and homeowners alike—with the most comprehensive and up-to-date resources in the area of home retention, halting unlawful foreclosure, and foreclosure defense litigation.

*As of today we have filed but are still awaiting our Letter of Exemption under Section 501c(3) of the Internal Revenue Code.

WHO IS NAFDA?

NAFDA has two types of members:

Homeowners: NAFDA advocates for homeowners and trains attorneys to defend against foreclosure actions by providing educational materials and legal support. NAFDA will:

  • Educate homeowners on the history, pitfalls, and predatory practices of the mortgage and home financing industry.
  • Educate homeowners on how to avoid predatory short-sale realtors, fraudulent loan modification scams, and improper foreclosure or sale of their home.
  • Teach homeowners to negotiate with loan modification and short-sales servicers on their own so that they understand the foreclosure game and can defend themselves against it.
  • Offer homeowners a library of videos on securitization, MERS, foreclosure, short-sale, and other foreclosure/mortgage issues to empower them in their defense.
  • Offer free consultations with attorneys to determine the merits of their case.
  • Provide homeowners with sample correspondence to enforce their rights under the Fair Debt Collection Practices Act (FDCPA), TILA, RESPA, and other consumer protection laws.

Attorneys:  In many foreclosure cases, especially in non-judicial foreclosure states, the only way for a homeowner to discover the real owner of their loan and to negotiate fair principle reduction loan modification is through litigation. Unfortunately, foreclosure defense is a brand new area of law without significant case precedence, with many cases falling under the jurisdiction of unsympathetic, uninformed, or prejudicial judges.

To pave the way for reform, NAFDA will educate and train attorneys on how to assist homeowners by providing:

  • National and local access to the most successful legal strategies, theories, case law, motion briefs, and pleading templates in foreclosure defense.
  • Access to a mentoring “foreclosure defense veteran” in each active local area. (NAFDA hosts city, regional, state, and circuit Chapters with an assigned foreclosure defense veteran as a Chapter leader).
  • Access to the most comprehensive and up-to-date legal resources to assist their clients with home retention and/or halting improper foreclosure.
  • Regular training seminars and Foreclosure Defense Forums (FDF) (offering CLE hours) where attorneys come together to learn from cutting-edge industry leaders and foreclosure defense pioneers who offer updates to members on current events in all jurisdictions.
